Before Chief Judge Patrick R. Grady in Tama County District Court in Toledo: Ernest Eugene Sam Jr., 37, rural Tama, in a plea agreement, pleaded guilty to a charge of lascivious acts with a child. He was sentenced to 10 years in prison. A $1,000 fine was suspended and Sam was assessed $692 court costs. He also must register as a sex offender. Four additional counts of lascivious acts with a child and a charge of 2nd degree sex abuse were dismissed as part of the plea agreement. Sam was charged on June 21, 2018, for allegedly engaging in sex acts with a minor child in the year 2002 and between August , 2015 and May 2016 on the Meskwaki Settlement. The charges were filed by Meskwaki Nation Tribal Police Detective Jacob Molitor. Nathan Wayne Cuellar,, admitted violation of terms of probation and a deferred judgment on a charge of elude or attempting to elude while participating in a felony, operating while intoxicated or bodily injury was revoked. He was sentenced to a suspended five-year prison term and placed on probation supervision for two years. Cuellar was cited in a probation violation report for failing to be at two probation office appointments, not residing at a Marshalltown address without probation officer permission to change and testing positive for methamphetamine usage. Cuellar, 35, previously of Marshalltown, no current address in court record, was sentenced on the eluding charge on Feb. 2, 2015. Victor Arquis Garcia, 21, rural Tama, was sentenced to 30 days in the Tama County Jail on a charge of 1st offense drunken driving. He previously pleaded guilty. He was also fined and assessed court costs totaling $1,998 and directed to complete drinking drivers school. One half of the fine amount may be waived if he provides proof he has obtained a temporary restricted license. On a charge of eluding to which he had als pleaded guilty to earlier, Garcia was granted a deferred judgment. He was placed on probation for five years to the 6th Judicial District Department of Correctional Services and directed to pay the probation enrollment fee. A civil penalty was suspended. Garcia was also ordered to pay restitution totaling $5,578n to Les and Kelly Meyers, Gilman, for damage to a machine shed, power riding mower and other shed contents. Garcia was charged on April 6 following a pursuit by Meskwaki Nation Tribal Police Officer Ethan Richter. Heather Sue Leohr, 32, Evansdale, admitted violation of terms of probation and was found in contempt of court. She as sentenced to serve two days in jail to be served concurrently with a Black Hawk County sentence. She will be discharged from probation after serving the jail time. Leohr was cited in a probation violation report for being arrested in Black Hawk County on charges possession of a controlled substance 2nd offense and possession of drug paraphernalia on May 17. Leohr pleaded guilty to charges of driving while barred and 3rd degree theft on June 9, 2017, and was sentenced to suspended jail time and placed on probation. The charges were filed following a theft at the Dollar General Store in Toledo and Leohr being observed in store parking lot video tape driving a white cadillac while she was barred form driving privileges on March 17, 2017. The charges were field by Toledo Police Chief Bob Kendall.

Before Judge Mitchell E. Turner in Tama County District Court in Toledo: Kendra Christine Savage, 18, Tama, entered a written guilty plea to and amended charge of 5th degree theft. She received a deferred judgment, was assessed a civil penalty and court costs totaling $214 and was placed on self supervised probation. She was ordered to pay $ 100 restitution to Maurice Wabaunasee. Savage as charge on Sept. 24 for unauthorized use of a credit card at the Kwik Star in Toledo without permission by Meskwaki Nation Tribal Police Officer Mustafa Abdekshahid.
