Before Judge Mary E. Chicchelly in Tama County District in Toledo: Katelynn Smith, 23, Hampton, Iowa, entered a written guilty plea to 5th degree theft. She was sentenced to two days in jail with credit for two days already served and was assessed $300 court costs. A portion of a bond in the amount of $300 totaling $283 in withheld to pay restitution. Smith was accused of writing a check on a closed account to Fareway Grocery, Toledo, in the amount of $221 on Aug. 20, 2013. Costs of the action totaled an additional $63 to Fareway. The charge was filed by Toledo Police Officer Dereck Fangman. Celina Marie Victor, 22, rural Tama, admitted violation of terms of probation. She was found in contempt of court and was ordered to seve five days in the Tama County Jail. Victor was accused in a probation violation report of failing to come to scheduled probation appointments in four instances in May and June. Victor was originally charged with 3rd degree theft involving the theft of a purse. The charge was filed by Tama Police Officer Brandon Boldt. She originally received a deferred judgment on a 4th degree theft charge. Austin Collin Fiebelkorn, 25, Marion, Iowa, was found in contempt of court for failing to abide with terms of probation. He as ordered to serve 21 days in jail with credit for any time served and is to be discharged from probation upon completion of the jail time. Fiebelkorn was cited in a probation violation report for being arrested on July 2 in Linn county on charges of 2nd offense possession of a controlled substance, possession of drug paraphernalia, 5th degree theft and carrying a concealed weapon. He originally was sentenced on a 1st offense drunken driving charge. Andrew James Bell, 38, Toledo, pleaded guilty to 1st offense drunken driving. He was sentenced to 90 days in jail with all but two days suspended, fined and assessed court costs totaling $1,798 and will be allowed to successfully complete the OWI Weekend Program in lieu of serving the jail time. He was placed on unsupervised probation. Bell was charged on June 7 on the U.S. Highway 30 Expressway by Toledo Police Officer Nathan Wunn. Michael Guy Wabaunasee, 33, admitted violation of terms of probation. he was found in contempt of court on two counts and sentenced to serve concurrent 30 day jail sentences with credit for 30 days already served. He was ordered to reside at a community corrections / residential center for up to 365 days. Wabaunasee was accused in a probation violation report of failing to obtain outpatient treatment, not reporting his whereabouts to probation and not coming to a scheduled probation appointment. He was serving probation time on charges of possession of a controlled substance -1 st offense, carrying weapons, 2nd offense drunken driving and 2nd offense domestic abuse assault. Kenneth Johns, 51, Ft. Dodge, entered and Alford plea to a charge of 2nd offense possession of methamphetamine. An Alford plea is not an admission of guilt but recognizes enough evidence exists to likely obtain a conviction in court. He was sentenced to two years in prison with the sentence to run concurrently with those imposed in Humboldt County and fined and assessed court costs totaling $1,632. Johns was charged on March 1 by Meskwaki Nation Tribal Police Officer Shawn Dahlin. Saare Gerezgiher, 19, Toledo, pleaded guilty to 1st offense drunken driving. He was sentenced to 30 days in jail with all but two days suspended and credited for two days already serve, fined and assessed court costs totaling $1,916 and placed on self-supervised probation. He must also complete drinking drivers school and obtain a substance abuse evaluation. His driver’s license was revoked for 180 days. Gerezgiher was charged on May 25 following a motor vehicle accident on Business Highway 30 by Toledo Police Officer Nathan Wunn.


Before Chief Judge Patrick Grady: Rose Mary Dietrich, 31, Belle Plaine, entered a written plea of guilty to 1st offense drunken driving. She was sentenced to two days in jail and may, in lieu of serving jail time, successfully complete the Marshall County Alternatives to Incarceration Program. She was fined and assessed court costs totaling $1,798 of which $625 of the fine amount may be waived if she provides proof to the court she has obtained a temporary restricted license. Dietrich was charged on April 27 on U.S. Highway 30 at M Avenue, rural Tama, by Tama County Deputy Sheriff Trevor Killian.
