Before Judge Andrew B. Chappell in Tama County District Court in Toledo:

Justin Immanuel Hernandez 31, Marshalltown, entered a written guilty plea to 2nd degree burglary. He received a suspended three-year prison term and a $1,000 fine including a $125 law enforcement surcharge were suspended. A total of $198 court costs were assessed. He was placed on probation for three years to the 6th Judicial District Department of Correctional Services, to pay the enrollment fee and provide a DNA sample. Charges of going armed with intent, assault while participating in a felony and assault with a dangerous weapon included in a County Attorney’s Information were dismissed. Hernandez was originally charged with 1st degree burglary on May 17,b 2017, in the 2000 block of 245th Street, rural Toledo ny Tama County Chief Deputy Sheriff Chad Hansen. He was accused of entering a residence by kicking in the door, placing a small caliber handgun on a counter and making threats to the occupants while eating a bowl of cereal. Jason Dean Davis, 46, Marshalltown, pleaded guilty to the amended charge of interference with official acts. He was fined and asses court costs totaling $438. Davis was originally charged on Jan.25 with impersonating a public official. He allegedly called the Tama county sheriff’s Office by telephone and identified himself as a Marshall County reserve sheriff’s deputy. The charge was field by Tama County Deputy Sheriff Joseph Quandt.

Before Judge Kevin McKeever: Austin William Phinney, 24, Toledo, entered a written guilty plea to driving while barred. He was sentenced to a suspended 180-day jail term, fined and assessed court costs totaling $944 and placed on unsupervised probation. Phinney was charged on Nov. 20, 2019, at 1st Street and Prospect Drive by Toledo Police Officer Jesse Brown. Due to ongoing restrictions in place byorder of the Iowa Supreme Court due to the COVID-19 pandemic, a total of 26 case management cases and 13 jury trials, plea hearings or initial appearances were continued during the seven-day period ending April 29.
