Mistrial is declared in Jefferson murder case
By John Speer CIP jspeer @tamatoledonews.com A mistrial was declared late Friday afternoon, Oct. 2, in the trial of Dustin Jerome Jefferson in Tama County District Court in Toledo. Jefferson is accused of aiding and abetting in the murder of his wife, Kerry O’Clair Jefferson, 32, in Tama on Sept. 25. 2013. A Tama County jury of 12 members and two alternates were unable to come to a decision after nearly three and one- half days of deliberations. Defense attorney Thomas Gaul moved for the mistrial Friday afternoon. Tama County Attorney Brent Heeren told The Chronicle – News-Herald the prosecution did not resist. The hung jury will likely result in a pre-trial conference and a new trial being set, Heeren said. Dustin Jefferson’s mother, Ginger Jefferson, 58, was convicted of 1st degree murder in 2014 by a Tama County Jury and sentenced to life in prison in the stabbing death of her daughter-in-law. The case was prosecuted by Assistant Iowa Attorney General Laura Roan and Heeren. The trial began with jury selection on Sept. 21 and testimony began in mid-afternoon of the following day. Dustin Jefferson continues to be held in the Tama County jail in Toledo on the aiding and abetting charge and unrelated 3rd degree sexual abuse charges.
